{"id":4836,"date":"2026-04-27T10:39:54","date_gmt":"2026-04-27T10:39:54","guid":{"rendered":"https:\/\/manseturfa.com\/?p=4836"},"modified":"2026-04-27T10:39:54","modified_gmt":"2026-04-27T10:39:54","slug":"ihd-urfa-subesinden-kalici-baris-ve-yasal-duzenleme-cagrisi","status":"publish","type":"post","link":"https:\/\/manseturfa.com\/?p=4836","title":{"rendered":"\u0130HD Urfa \u015eubesi\u2019nden \u201cKal\u0131c\u0131 bar\u0131\u015f ve yasal d\u00fczenleme\u201d \u00e7a\u011fr\u0131s\u0131!"},"content":{"rendered":"<p>\u015eanl\u0131urfa\u2019da \u0130nsan Haklar\u0131 Derne\u011fi (\u0130HD) \u015eubesi taraf\u0131ndan, K\u00fcrt meselesinin \u00e7\u00f6z\u00fcm s\u00fcreci, silahs\u0131zlanma ad\u0131mlar\u0131 ve demokratikle\u015fme beklentilerine ili\u015fkin bir bas\u0131n a\u00e7\u0131klamas\u0131 yap\u0131ld\u0131.<\/p>\n<p>A\u00e7\u0131klamada, s\u00fcrecin geldi\u011fi a\u015fama, hukuki d\u00fczenlemelerin \u00f6nemi ve kal\u0131c\u0131 bar\u0131\u015f i\u00e7in at\u0131lmas\u0131 gereken ad\u0131mlardan bahsedildi.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"\u0130HD Urfa \u015eubesi\u2019nden \u201cKal\u0131c\u0131 bar\u0131\u015f ve yasal d\u00fczenleme\u201d \u00e7a\u011fr\u0131s\u0131!\" class=\"mx-auto max-w-full h-auto shadow-sm\" height=\"675\" src=\"https:\/\/www.urfahaber.com\/images\/uploads\/2026\/04\/whatsapp-image-2026-04-27-at-125151-pm-69ef3d4defb21.jpeg\" width=\"1200\" \/><\/p>\n<p>Konuya ili\u015fkin a\u00e7\u0131klama yapan \u0130HD \u015eanl\u0131urfa \u015eubesi E\u015f Ba\u015fkan\u0131 Song\u00fcl Arpa, \u015fu ifadeleri kulland\u0131:<\/p>\n<p>&#8221;T\u00fcrkiye, K\u00fcrt meselesinin demokratik ve bar\u0131\u015f\u00e7\u0131l \u00e7\u00f6z\u00fcm\u00fc konusunda toplumun t\u00fcm kesimlerinde b\u00fcy\u00fck bir umut yaratan, ancak bir yandan da belirsizliklerle \u00f6rt\u00fcl\u00fc tarihi bir s\u00fcre\u00e7ten ge\u00e7mektedir. 1 Ekim 2024 tarihinde ba\u015flayan s\u00fcre\u00e7, PKK\u2019nin silah b\u0131rakma ve kendini feshetme karar\u0131yla somut bir a\u015famaya evrilmi\u015f, silahlar\u0131n susmas\u0131yla birlikte geli\u015fen diyalog kanallar\u0131 t\u00fcm hak savunucular\u0131 ve toplum taraf\u0131ndan memnuniyetle kar\u015f\u0131lanm\u0131\u015ft\u0131r.<\/p>\n<p>\u0130nsan Haklar\u0131 Derne\u011fi olarak, silahlar\u0131n susmas\u0131n\u0131n ve \u00e7at\u0131\u015fmal\u0131 ortamdan kaynakl\u0131 ya\u015fam hakk\u0131 ihlallerinin ortadan kalkmas\u0131n\u0131n tek ba\u015f\u0131na b\u00fct\u00fcn halklar\u0131n bar\u0131\u015f fikri etraf\u0131nda bir araya gelmesi i\u00e7in yeterli bir neden oldu\u011fu kanaatindeyiz. Bununla birlikte, hukuksal reformlarla desteklenemeyen ve hukuki bir g\u00fcvenceye ba\u011flanmayan m\u00fczakere s\u00fcre\u00e7lerinin kal\u0131c\u0131 bar\u0131\u015fla sonu\u00e7lanmas\u0131 da m\u00fcmk\u00fcn g\u00f6r\u00fcnmemektedir. Nitekim 2013-2015 y\u0131llar\u0131 aras\u0131nda y\u00fcr\u00fct\u00fclen \u00e7\u00f6z\u00fcm s\u00fcrecinin ba\u015far\u0131s\u0131zl\u0131kla sonu\u00e7lanmas\u0131n\u0131n sebeplerinden biri de hi\u00e7 ku\u015fkusuz s\u00fcrecin gereklerine dair hukuki ve idari reformlar\u0131n hayata ge\u00e7irilmemesiydi.<\/p>\n<p>T\u00fcrkiye\u2019nin yak\u0131n ge\u00e7mi\u015fteki ba\u015far\u0131s\u0131z \u00e7\u00f6z\u00fcm giri\u015fimi ve d\u00fcnya \u00f6rnekleri g\u00f6zetildi\u011finde bar\u0131\u015f s\u00fcrecinin kesintiye u\u011framamas\u0131 ve nihai olarak da ba\u015far\u0131ya ula\u015fmas\u0131 i\u00e7in gerekli reformlar\u0131n h\u0131zl\u0131ca hayata ge\u00e7irilmesi hayati \u00f6nem ta\u015f\u0131maktad\u0131r. Mevcut durumda fiili silahs\u0131zlanma iradesine kar\u015f\u0131l\u0131k, devletin bu iradeyi destekleyecek \u201cge\u00e7i\u015f d\u00f6nemi yasalar\u0131n\u0131\u201d hayata ge\u00e7irme konusunda s\u00f6ylem d\u00fczeyinde kalan baz\u0131 beyanlar haricinde s\u00fcreci tahkim edecek somut ad\u0131mlara d\u00f6n\u00fc\u015fmemi\u015ftir. D\u00fcnyadaki \u00e7at\u0131\u015fma \u00e7\u00f6z\u00fcm\u00fc deneyimleri g\u00f6stermi\u015ftir ki; hukuki ve idari reformlarla desteklenmeyen, yasal stat\u00fcye kavu\u015fturulmayan m\u00fczakere giri\u015fimleri, tekrarlanma ve eskiye d\u00f6n\u00fc\u015f riski ta\u015f\u0131maktad\u0131r.<\/p>\n<p>K\u00fcrt Meselesinin \u00e7\u00f6z\u00fcm\u00fc konusunda \u00f6nemli bir ad\u0131m olarak de\u011ferlendirdi\u011fimiz TBMM Milli Dayan\u0131\u015fma Karde\u015flik ve Demokrasi Komisyonu\u2019nun, nihai raporunu tamamlay\u0131p Meclise sunmas\u0131n\u0131n \u00fczerinden iki ay\u0131 a\u015fk\u0131n bir s\u00fcre ge\u00e7mi\u015ftir. Siyasi akt\u00f6rler yap\u0131lmas\u0131 planlanan reformlara dair bayram<\/p>\n<p>sonras\u0131n\u0131 i\u015faret etmesine ra\u011fmen bug\u00fcne kadar hi\u00e7bir ad\u0131m\u0131n at\u0131lmam\u0131\u015f olmas\u0131 endi\u015fe vericidir. 2025 y\u0131l\u0131 i\u00e7erisinde de mu\u011flak da olsa \u00e7e\u015fitli zaman dilimlerine infaz yasas\u0131 ba\u015fta olmak \u00fczere baz\u0131 yasal d\u00fczenlemelere i\u015faret edilmi\u015f ancak her defas\u0131nda ulusal ve b\u00f6lgesel geli\u015fmeler gerek\u00e7e g\u00f6sterilerek geri ad\u0131m at\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>H\u00fck\u00fcmet, K\u00fcrt Meselesinin \u00e7\u00f6z\u00fcm\u00fcn\u00fc konjonkt\u00fcrel bir zorunluluktan ziyade temel hak ve \u00f6zg\u00fcrl\u00fckler perspektifinden stratejik bir bak\u0131\u015f a\u00e7\u0131s\u0131yla ele almal\u0131d\u0131r. Bu ba\u011flamda s\u00fcre\u00e7, yaln\u0131zca bir g\u00fcvenlik veya teknik silahs\u0131zlanma meselesi olarak de\u011fil, T\u00fcrkiye\u2019nin demokratikle\u015fme kapasitesini g\u00fc\u00e7lendirme, kal\u0131c\u0131 i\u00e7 bar\u0131\u015f\u0131 kurma iradesi ve nihayet b\u00f6lgesel krizler kar\u015f\u0131s\u0131nda ulusal ve b\u00f6lgesel istikrar \u00fcretme becerisini de kapsayacak bir \u015fekilde d\u00fczenlenmelidir.<\/p>\n<p>D\u00fcnya deneyimleri, \u00e7at\u0131\u015fma \u00e7\u00f6z\u00fcmlerinin en zor ve uzun s\u00fcren a\u015famas\u0131n\u0131n \u201csilahs\u0131zlanma\u201d a\u015famas\u0131 oldu\u011funu g\u00f6stermi\u015ftir. Buna kar\u015f\u0131l\u0131k T\u00fcrkiye\u2019de bu evre sorunsuz bir \u015fekilde ve s\u00fcrecin hemen ba\u015f\u0131nda ger\u00e7ekle\u015fmi\u015f, devletin bu a\u015famay\u0131 tahkim edecek d\u00fczenlemeler yapmas\u0131 beklenmektedir. Fiili olarak sa\u011flanan silahs\u0131zlanma, ba\u015fkaca teyit ve tespit ko\u015fuluna ba\u011flanmaks\u0131z\u0131n, yasal ad\u0131mlarla g\u00fcvence alt\u0131na al\u0131nmal\u0131d\u0131r. H\u00fck\u00fcmet zaman ge\u00e7irmeden ve muhtemel yol kazalar\u0131na mahal vermeden PKK\u2019nin silahs\u0131zlanma karar\u0131n\u0131 tahkim edecek ad\u0131mlar atmal\u0131 ve bu konuda ivedilikle gerekli yasal d\u00fczenlemeleri yapmal\u0131d\u0131r. Bu kapsamda;<\/p>\n<p>PKK\u2019nin silah b\u0131rakmas\u0131na ili\u015fkin \u00e7er\u00e7eve yasa, daha fazla ertelenmeden en k\u0131sa zamanda \u00e7\u0131kar\u0131lmal\u0131 ve a\u015fa\u011f\u0131daki hususlar\u0131 i\u00e7ermelidir. Bu yasa:<\/p>\n<p>Yasa geni\u015f ve kapsaml\u0131 olmal\u0131, \u00e7at\u0131\u015fman\u0131n b\u00fct\u00fcn sonu\u00e7lar\u0131n\u0131 tamamen bertaraf etme amac\u0131 ta\u015f\u0131mal\u0131d\u0131r. B\u00fct\u00fcnl\u00fck\u00e7\u00fc bir bak\u0131\u015fla kaleme al\u0131nmal\u0131, a\u00e7\u0131k ve \u00f6l\u00e7\u00fclebilir bir ama\u00e7 ta\u015f\u0131mal\u0131d\u0131r. Yasa kapsam\u0131na ald\u0131\u011f\u0131 gruplar\u0131 a\u00e7\u0131kl\u0131k\u00e7a belirmeli ve bunu yaparken grup \u00fcyelerinden hi\u00e7birinin d\u0131\u015far\u0131da b\u0131rak\u0131lmamas\u0131na \u00f6zen g\u00f6stermelidir.<\/p>\n<p>Yasa metni a\u00e7\u0131k, yoruma kapal\u0131 ve \u00f6ng\u00f6r\u00fclebilir olmal\u0131, infaz ve d\u00f6n\u00fc\u015f s\u00fcre\u00e7lerinde idari ve hukuki keyfili\u011fi \u00f6nleyecek kesinlikler ve g\u00fcvenceler i\u00e7ermelidir.<\/p>\n<p>Silah b\u0131rakanlar\u0131n e\u011fitim, sa\u011fl\u0131k, istihdam ve benzeri alanlardaki gereksinimlerini kar\u015f\u0131lamak \u00fczere destek mekanizmalar\u0131 kurmal\u0131d\u0131r.<br \/> Bu yasan\u0131n uygulanmas\u0131n\u0131 izlemek \u00fczere TBMM b\u00fcnyesinde t\u0131pk\u0131 TBMM Milli Dayan\u0131\u015fma Karde\u015flik ve Demokrasi Komisyonu \u00f6rne\u011finde oldu\u011fu gibi t\u00fcm siyasi partilerin kat\u0131l\u0131m\u0131yla bir \u201c\u0130zleme ve Denetleme Komisyonu\u201d olu\u015fturulmal\u0131d\u0131r. Bu komisyon, belli aral\u0131klarla haz\u0131rlad\u0131\u011f\u0131 raporlar\u0131 Meclis\u2019e sunmal\u0131d\u0131r. Bu Komisyon sivil toplum \u00f6rg\u00fctlerinin kat\u0131l\u0131m\u0131na a\u00e7\u0131k, somut ve s\u00fcreklilik arz eden bir \u00e7al\u0131\u015fma y\u00f6ntemi geli\u015ftirmelidir.<\/p>\n<p>\u0130HD olarak kal\u0131c\u0131 bar\u0131\u015f\u0131n ve demokratik bir d\u00fczenin in\u015fas\u0131 i\u00e7in b\u00fct\u00fcn siyasi mahpuslar\u0131 \u00f6zg\u00fcrl\u00fcklerine kavu\u015fturacak bir yasal d\u00fczenlemenin yap\u0131lmas\u0131n\u0131 talep ediyoruz. Demokratik bir toplum d\u00fczeni ve g\u00fcvenli bir gelecek ancak ge\u00e7mi\u015fle y\u00fczle\u015fme, hakikat ve onar\u0131m s\u00fcre\u00e7lerinin i\u015fletilmesi ile m\u00fcmk\u00fcn olacakt\u0131r. Bu ba\u011flamda taraflar\u0131n sivillere kar\u015f\u0131 i\u015fledi\u011fi su\u00e7lar bak\u0131m\u0131ndan hakikat, adalet ve onar\u0131m\u0131 oda\u011f\u0131na alan ko\u015fullu sorumluluk mekanizmalar\u0131 kurulmal\u0131 ve etkin bir \u015fekilde i\u015fletilmelidir.<\/p>\n<p>TBMM Milli Dayan\u0131\u015fma Karde\u015flik ve Demokrasi Komisyonu taraf\u0131ndan meclise sunulan nihai raporun 7. B\u00f6l\u00fcm\u00fcnde belirtilen t\u00fcm demokratikle\u015fme ad\u0131mlar\u0131 ivedilikle hayata ge\u00e7irilmelidir.
